Terms of Use

These terms explain the rules for using TallyNest, a local-first home inventory and upkeep app for iPhone. TallyNest is a personal organization tool, not a professional legal, insurance, appraisal, safety, or maintenance service.

1. Agreement

These Terms of Use govern your use of TallyNest, including the iOS app, its features, TallyNest Pro, and the support pages.

By downloading, accessing, purchasing, or using TallyNest, you agree to these Terms and to the TallyNest Privacy Policy. If you do not agree, do not use TallyNest.

2. Apple App Store Terms

TallyNest is distributed through the Apple App Store. Apps obtained through the App Store are licensed, not sold, and your license is also subject to Apple's applicable App Store terms and Apple's Licensed Application End User License Agreement unless a separate custom EULA applies. Apple is not responsible for providing maintenance or support for TallyNest unless Apple's own terms require otherwise; support requests should be sent to [email protected]. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you.

3. Acceptable Use

You agree not to use TallyNest to:

  • Violate any law or third-party right.
  • Attempt to access another person's device, data, or records.
  • Reverse engineer, attack, overload, or misuse the app, purchase system, or related services.
  • Rely on the app to make unsafe decisions or as a replacement for professional, legal, insurance, or safety advice.

4. Your Content and Responsibility

You own the records you create in TallyNest, including your homes, spaces, inventory items, notes, dates, reminders, and attachments. Soldra does not claim ownership of your records.

You are responsible for the accuracy, legality, and backup of the content you create or import, and for having the right to use any photos or documents you add.

Warranty dates, reminders, and other details in TallyNest are informational only and are managed by you. They are estimates and can be wrong, missed, or delayed, and TallyNest does not guarantee that a reminder will appear at a specific time. TallyNest is not a guarantee about any warranty, insurance policy, appraisal, or the condition or value of your property, and it does not create or extend any warranty. Keep original receipts and warranty documents, and follow manufacturer or professional advice where it matters.

The TallyNest app and its own content, design, and trademarks are owned by Soldra or its licensors and are licensed to you for personal, non-commercial use.

5. Local Storage, Backups, and Data Loss

TallyNest keeps your records on your device. It does not operate a cloud database for your records, so there is no server-side copy for us to recover.

If you delete a record, use Settings → Delete all data, delete the app, lose or replace your device, or your device or backups fail, your local data may be permanently lost.

You are responsible for maintaining your own backups. Use the app's backup or export feature and your device's backup options where appropriate.

6. Purchases and Subscriptions

TallyNest may offer TallyNest Pro through Apple in-app purchase. Prices and the features included are shown in the app and in the App Store purchase sheet before you buy. Apple processes the payment, and RevenueCat helps deliver and restore your entitlement.

  • Where TallyNest Pro is offered as a one-time purchase, you can restore it on the same Apple Account using Settings → Restore purchases.
  • Where TallyNest Pro is offered as an auto-renewing subscription, it renews automatically unless canceled at least 24 hours before the end of the current period, and your Apple Account may be charged for renewal within 24 hours before the period ends, subject to Apple's rules.
  • You can manage or cancel a subscription in your Apple Account subscription settings.
  • Deleting the app does not cancel a subscription.
  • Refund requests are handled by Apple according to Apple's policies.

7. Disclaimers

TallyNest is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the app, reminders, warranty dates, backups, purchase state, or any other feature will be uninterrupted, error-free, accurate, or suitable for your specific situation.

TallyNest is a personal organization tool. It is not legal, insurance, appraisal, financial, safety, or other professional advice, and it is not a substitute for qualified professional support or for reading manufacturer and warranty documents.

8. Limitation of Liability

To the maximum extent permitted by law, Soldra and its developer are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, records, profits, or opportunities arising from your use of TallyNest, including any lost local data or any missed or delayed reminder.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law.

9. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Soldra and its owners, developers, affiliates, service providers, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to your use of TallyNest, the content you create or import, your violation of these Terms, your violation of any law or third-party right, or your reliance on any output of TallyNest.

10. Governing Law

These Terms are governed by the laws applicable where Soldra is established, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws in your country of residence provide otherwise. Mandatory consumer rights continue to apply where local law requires them.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be applied to the extent permitted by law.

12. Changes to These Terms

These Terms may be updated when the app, purchases, legal requirements, or business practices change. The effective date above shows when this version took effect. Continued use after an update means you accept the updated Terms.
