Terms of Service

These terms explain the rules for using Botanica, including plant records, care reminders, AI-assisted plant diagnosis, Botanica Pro purchases, local storage, and support.

1. Agreement

These Terms of Service govern your use of Botanica, including the iOS app, local plant records, the AI diagnosis feature, Botanica Pro purchases, these public support pages, and related services.

By downloading, accessing, purchasing, subscribing to, or using Botanica, you agree to these Terms and to the Botanica Privacy Policy. If you do not agree, do not use Botanica.

2. App Store Terms

Botanica may be distributed through the Apple App Store. Apps obtained through the App Store are licensed, not sold, and your use may also be subject to Apple's applicable App Store, payment, subscription, family sharing, refund, and licensed application terms.

Unless Botanica provides a separate custom end-user license agreement for a specific version, Apple's standard licensed application end-user license agreement may apply as required by Apple. Apple is not responsible for providing maintenance or support for Botanica unless Apple's own terms require otherwise. Support requests should be sent to [email protected].

To the extent required by Apple terms, Apple and its subsidiaries may be third-party beneficiaries of relevant App Store-related provisions of these Terms.

3. What Botanica Does

Botanica is a plant care app for iOS. Depending on the app version and your access level, Botanica can help:

  • Identify a plant from a photo, including a common name and Latin name, with confidence levels.
  • Assess whether a plant looks healthy or sick, and describe a likely condition and severity.
  • Generate a step-by-step cure plan and quick care tips for a diagnosis.
  • Suggest when to recheck a plant and send a care reminder if you enable notifications.
  • Save check-ups over time and compare a plant's condition with a before/after view.
  • Store your plants, diagnoses, cure steps, care tips, and photos locally on your device.
  • Use Botanica Pro features where available.

4. Eligibility

Botanica is not directed to children under 13. The AI diagnosis feature is intended for users who are at least 18 years old or are using the app with appropriate adult involvement. If you use Botanica on behalf of another person, household, or organization, you confirm that you have authority to do so.

5. Your Content

"Your Content" means content you provide to Botanica, including plant photos, camera captures, plant names, saved diagnoses, support messages, feedback messages, and any related information you choose to submit.

You keep ownership of Your Content. You give Botanica a limited, non-exclusive, worldwide license to process, transmit, transform, display, and store Your Content only as needed to provide, maintain, protect, improve, and support Botanica and the features you choose to use. This includes sending the photo you choose to diagnose to Cloudflare and Google Gemini, and sending purchase information to Apple and RevenueCat, as described in the Privacy Policy.

You are responsible for Your Content. Do not submit content unless you have the rights, permissions, and authority needed to use it with Botanica and its service providers.

6. AI-Assisted Diagnosis and Generated Output

Botanica uses the Google Gemini API through the Botanica backend to analyze the photo you select and generate a structured diagnosis. AI output can include a possible species, health status, condition, severity, confidence labels, cure steps, care tips, and a recheck interval.

AI output is generated automatically and can be inaccurate, incomplete, misleading, outdated, unsafe, or unsuitable for your circumstances. A diagnosis may misidentify a plant, misread a photo, miss a real problem, or overstate visible evidence. You must independently review the species, condition, confidence labels, and cure steps before relying on them.

Botanica does not guarantee that generated output is unique. Similar or identical output may be generated for other users, plants, or photos.

7. Plant Care and Professional Advice Disclaimer

Botanica provides educational plant-keeping tools. It is not professional horticultural, agricultural, botanical, or safety advice, and it is not a substitute for qualified professional judgment.

You should not rely on Botanica alone for:

  • Deciding whether a plant, berry, leaf, or mushroom is safe to touch, eat, or keep around people or pets.
  • Identifying toxic, allergenic, invasive, protected, or regulated plants.
  • Applying fertilizers, pesticides, or other chemicals, including dosing and safety decisions.
  • Decisions about valuable, rare, or commercially important plants.
  • Any medical decision about a person or animal that may have contacted or ingested a plant.

For important, safety-related, or high-value decisions, confirm with reliable references and a qualified professional such as a horticulturist, botanist, agricultural extension service, veterinarian, or poison control service, as appropriate. In an emergency involving a person or animal, contact local emergency or poison control services.

8. Photo Quality and User Responsibility

Diagnosis quality depends on the photo, including lighting, focus, framing, the part of the plant shown, and how clearly the problem is visible. You are responsible for checking whether the image is good enough for the result to be useful.

  • Use a clear, bright, in-focus photo with the plant or affected area visible.
  • Do not treat a low-confidence result as a fact.
  • Confirm a species before acting on it, especially for anything you might touch, eat, or give to a pet.
  • Avoid making several drastic changes to a plant at once based only on an AI diagnosis.

9. Acceptable Use

You agree not to use Botanica to:

  • Violate any law, regulation, platform rule, provider term, or third-party right.
  • Upload images or content you do not have the right to use.
  • Submit highly sensitive personal, medical, financial, government ID, password, API key, confidential, or safety-critical information.
  • Bypass subscription checks, access controls, rate limits, anti-abuse measures, or provider restrictions.
  • Reverse engineer, scrape, attack, overload, disrupt, or misuse Botanica, its backend, or its providers.
  • Use generated output to mislead others about plant identity, safety, edibility, toxicity, or guaranteed outcomes.
  • Use Botanica in any medical, emergency, regulated, inspection, or safety-critical setting where an inaccurate result could cause harm.

10. Local Storage and Backups

Botanica stores your app data locally on your device. You are responsible for maintaining your device, backups, and access to your data. Botanica does not provide a cloud account for recovering deleted plants, diagnoses, cure steps, care tips, photos, or settings.

Deleting a plant, deleting the app, device failure, operating system behavior, storage limits, or interrupted storage operations may permanently remove local Botanica data.

11. Botanica Pro, Subscriptions, and Purchases

Botanica may offer Pro access through Apple App Store in-app purchase. Pro access is currently associated with the RevenueCat entitlement plant doctor AI Pro, depending on app version and App Store configuration.

Exact product names, prices, subscription periods, trial or offer terms, renewal terms, included features, taxes, and App Store conditions are shown in the App Store purchase sheet before you confirm a purchase.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions renew automatically unless canceled according to Apple's rules before the end of the current period.
  • Your Apple Account may be charged for renewal before the end of the current period according to Apple rules.
  • You can manage or cancel subscriptions in your Apple Account subscription settings.
  • Deleting Botanica does not automatically cancel a subscription.
  • Refunds, billing issues, family sharing, taxes, payment methods, and store disputes are handled by Apple according to its policies.
  • RevenueCat is used to validate purchases, restore purchases, and determine whether Pro access is active.

Pro features, free features, diagnosis limits, included tools, pricing, and availability may change over time. Pro access means access to the eligible Botanica Pro features offered in the app, not to unrelated future apps or every future feature.

12. Availability and Changes

Botanica depends on your device, iOS, App Store services, RevenueCat, Cloudflare, Google Gemini, network access, backend capacity, and provider availability. Features may be delayed, unavailable, changed, rate-limited, discontinued, or inaccurate.

Botanica may change app features, AI models, providers, prompts, backend limits, subscriptions, prices, Pro features, and public pages over time.

13. Privacy

Botanica privacy practices are described in the Privacy Policy. By using the AI diagnosis feature, you acknowledge that the photo you select and your language are sent to Botanica backend services and Google Gemini for automated analysis.

14. Intellectual Property

Botanica, including its app design, software, branding, prompts, workflows, icons, public pages, and related materials, is owned by Botanica or its developer and is protected by applicable intellectual property laws. These Terms do not give you ownership of Botanica.

Subject to these Terms and applicable App Store terms, you receive a limited, revocable, non-transferable, non-exclusive license to use Botanica for personal, non-commercial plant care purposes.

15. No Warranty

Botanica is provided "as is" and "as available." We do not guarantee that every identification, diagnosis, confidence label, cure step, reminder, local storage operation, purchase state, notification, or app behavior will be accurate, uninterrupted, secure, error-free, or suitable for your plant.

Botanica does not guarantee plant health, plant survival, treatment results, correct identification, or any particular gardening outcome.

16. Limitation of Liability

To the maximum extent permitted by law, Botanica and its developer are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunities, property, plants, or plant value arising from use of or inability to use the app.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law.

17. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Soldra and its owners, developers, affiliates, service providers, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to your use of Botanica, the content you create or import, your violation of these Terms, your violation of any law or third-party right, or your reliance on any output of Botanica.

18. Termination

You may stop using Botanica at any time. We may suspend or limit access to network features if required to protect the app, backend, providers, users, legal compliance, or service reliability, or if you violate these Terms.

Termination does not automatically cancel App Store subscriptions. Manage subscriptions through your Apple Account settings.

19. Changes to These Terms

These Terms may be updated when Botanica changes, when service providers or legal requirements change, or when purchase, AI, data, or business practices change. The effective date above shows when this version took effect. Continued use of Botanica after an update means you accept the updated Terms, to the extent permitted by law.
