Terms of Service

These terms explain the rules for using AquariumBuddy, including aquarium records, reminders, water-test logging, AI-assisted photo scans, AquariumBuddy Pro purchases, local storage, and support.

1. Agreement

These Terms of Service govern your use of AquariumBuddy, including the iOS app, local aquarium records, AI scan features, AquariumBuddy Pro purchases, public support pages, and related services.

By downloading, accessing, purchasing, subscribing to, or using AquariumBuddy, you agree to these Terms and to the AquariumBuddy Privacy Policy. If you do not agree, do not use AquariumBuddy.

2. App Store Terms

AquariumBuddy may be distributed through the Apple App Store. Apps obtained through the App Store are licensed, not sold, and your use may also be subject to Apple's applicable App Store, payment, subscription, family sharing, refund, and licensed application terms.

Unless AquariumBuddy provides a separate custom end-user license agreement for a specific version, Apple's standard licensed application end-user license agreement may apply as required by Apple. Apple is not responsible for providing maintenance or support for AquariumBuddy unless Apple's own terms require otherwise. Support requests should be sent to support@aquariumbuddy.app.

To the extent required by Apple terms, Apple and its subsidiaries may be third-party beneficiaries of relevant App Store-related provisions of these Terms.

3. What AquariumBuddy Does

AquariumBuddy is an aquarium care app for iOS. Depending on the app version and your access level, AquariumBuddy can help:

  • Create aquarium profiles with tank size, type, fish, plants, equipment, schedules, temperature target, and notes.
  • Track care reminders for feeding, lights, water tests, water changes, filter cleaning, notes, and custom care tasks.
  • Log water-test values for pH, ammonia, nitrite, nitrate, and temperature.
  • Review care history, water history, scan history, and local coach recommendations.
  • Use a local species library and compatibility guidance for common aquarium animals.
  • Analyze chosen aquarium, fish, plant, product, problem, and water-test photos with AI-assisted observations.
  • Store scan observations and selected scan images locally with the relevant aquarium profile.
  • Use AquariumBuddy Pro features such as cycle tracking, water-test reminders, and saved AI scan history where available.

4. Eligibility

AquariumBuddy is not directed to children under 13. AI scan features are intended for users who are at least 18 years old or are using the app with appropriate adult involvement. If you use AquariumBuddy on behalf of another person, household, school, organization, store, or aquarium service, you confirm that you have authority to do so.

5. Your Content

"Your Content" means content you provide to AquariumBuddy, including aquarium profiles, fish and plant lists, equipment details, care logs, water-test values, notes, selected photos, camera captures, scan mode selections, support messages, feedback messages, and any related information you choose to submit.

You keep ownership of Your Content. You give AquariumBuddy a limited, non-exclusive, worldwide license to process, transmit, transform, display, and store Your Content only as needed to provide, maintain, protect, improve, and support AquariumBuddy and the features you choose to use. This includes sending relevant AI scan content to Cloudflare and Google Gemini, and sending purchase information to Apple and RevenueCat as described in the Privacy Policy.

You are responsible for Your Content. Do not submit content unless you have the rights, permissions, and authority needed to use it with AquariumBuddy and its service providers.

6. AI-Assisted Scans and Generated Output

AquariumBuddy uses Google Gemini API through the AquariumBuddy backend to analyze selected photos and generate structured observations. AI output can include possible visible findings, risks, confidence labels, categories, next steps, species or plant possibilities, product-use notes, water-test reading notes, and other educational guidance.

AI output is generated automatically and can be inaccurate, incomplete, misleading, outdated, unsafe, or unsuitable for your circumstances. AI scans may miss important problems, misread photos, misunderstand water-test colors, misidentify livestock or plants, or overstate visible evidence. You must independently review all observations, confidence labels, warnings, and next steps before relying on them.

AquariumBuddy does not guarantee that generated output is unique. Similar or identical output may be generated for other users, aquariums, scans, or contexts.

7. Animal Health, Water Quality, and Professional Advice Disclaimer

AquariumBuddy provides educational aquarium-keeping tools. It is not veterinary advice, medical advice, animal treatment advice, laboratory testing, emergency support, a calibrated water-testing device, or a substitute for qualified professional judgment.

You should not rely on AquariumBuddy alone for:

  • Diagnosing or treating fish, shrimp, snails, plants, or other aquarium life.
  • Emergency animal-health, livestock safety, poisoning, disease outbreak, quarantine, or euthanasia decisions.
  • Medication dosing, chemical dosing, salt dosing, product safety, or compatibility decisions.
  • Determining whether an aquarium is safe without direct water testing and observation.
  • Expensive livestock purchases, stocking decisions, equipment changes, or legal/commercial aquarium service decisions.

For important or urgent decisions, use reliable water test kits, direct observation, product labels, quarantine practice, experienced husbandry judgment, and advice from a qualified aquatic veterinarian or knowledgeable local aquarium professional.

8. Scan Quality and User Responsibility

AI scan quality depends on the photo, lighting, focus, reflections, water clarity, angle, fish movement, color accuracy, the selected scan type, and the tank context you entered. You are responsible for checking whether the image, scan type, water readings, and tank profile are accurate enough for the result to be useful.

  • Use clear, bright photos with the relevant subject visible.
  • Retest water values directly before acting on a water-test scan.
  • Compare fish health observations with behavior, appetite, breathing, quarantine context, and water quality.
  • Do not treat low-confidence or AI-assisted observations as facts.
  • Avoid changing several aquarium variables at once based only on an AI scan.

9. Acceptable Use

You agree not to use AquariumBuddy to:

  • Violate any law, regulation, platform rule, provider term, or third-party right.
  • Upload images, notes, or content you do not have the right to use.
  • Submit highly sensitive personal, medical, financial, government ID, password, API key, confidential, or safety-critical information.
  • Bypass subscription checks, access controls, rate limits, safety guidance, backend limits, or provider restrictions.
  • Reverse engineer, scrape, attack, overload, disrupt, or misuse AquariumBuddy, its backend, or its providers.
  • Use generated output to mislead others about diagnosis, treatment, water safety, product safety, stocking safety, professional verification, or guaranteed outcomes.
  • Use AquariumBuddy in any veterinary, medical, emergency, regulated, inspection, legal, or safety-critical setting where inaccurate guidance could cause harm.

10. Local Storage and Backups

AquariumBuddy stores most app data locally on your device. You are responsible for maintaining your device, backups, and access to your data. AquariumBuddy does not provide a cloud account for recovering deleted tank profiles, water tests, care logs, scan history, saved scan images, notes, or settings.

Deleting app data, deleting the app, resetting local aquarium data, device failure, operating system behavior, storage limits, or interrupted storage operations may permanently remove local AquariumBuddy data.

11. AquariumBuddy Pro, Subscriptions, and Purchases

AquariumBuddy may offer Pro access through Apple App Store in-app purchase. Pro access is currently associated with the RevenueCat entitlement ID aquariumbuddy_pro and may use package identifiers such as monthly and yearly, depending on app version and App Store configuration.

Exact product names, prices, subscription periods, trial or offer terms, renewal terms, included features, taxes, and App Store conditions are shown in the App Store purchase sheet before you confirm a purchase.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions renew automatically unless canceled according to Apple's rules before the end of the current period.
  • Your Apple Account may be charged for renewal before the end of the current period according to Apple rules.
  • You can manage or cancel subscriptions in your Apple Account subscription settings.
  • Deleting AquariumBuddy does not automatically cancel a subscription.
  • Refunds, billing issues, family sharing, taxes, payment methods, and store disputes are handled by Apple according to its policies.
  • RevenueCat is used to validate purchases, restore purchases, and determine whether Pro access is active.

Pro features, free features, scan limits, included tools, pricing, and availability may change over time. Pro access means access to the eligible AquariumBuddy Pro features offered in the app, not to unrelated future apps or every future feature.

12. Availability and Changes

AquariumBuddy depends on your device, iOS, App Store services, RevenueCat, Cloudflare, Google Gemini, network access, backend capacity, and provider availability. Features may be delayed, unavailable, changed, rate-limited, discontinued, or inaccurate.

AquariumBuddy may change app features, AI models, providers, prompts, backend limits, scan modes, subscriptions, prices, Pro features, and public pages over time.

13. Privacy

AquariumBuddy privacy practices are described in the Privacy Policy. By using AI scan features, you acknowledge that selected images and scan context are sent to AquariumBuddy backend services and Google Gemini for automated analysis.

14. Intellectual Property

AquariumBuddy, including its app design, software, branding, prompts, workflows, icons, public pages, and related materials, is owned by AquariumBuddy or its developer and is protected by applicable intellectual property laws. These Terms do not give you ownership of AquariumBuddy.

Subject to these Terms and applicable App Store terms, you receive a limited, revocable, non-transferable, non-exclusive license to use AquariumBuddy for personal, non-commercial aquarium care purposes.

15. No Warranty

AquariumBuddy is provided "as is" and "as available." We do not guarantee that every reminder, water status, local storage operation, scan, generated observation, confidence label, product note, purchase state, notification, or app behavior will be accurate, uninterrupted, secure, error-free, or suitable for your aquarium.

AquariumBuddy does not guarantee fish health, plant health, livestock survival, water safety, treatment results, equipment performance, product compatibility, or any particular aquarium outcome.

16. Limitation of Liability

To the maximum extent permitted by law, AquariumBuddy and its developer are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunities, property, livestock, plants, equipment, or aquarium value arising from use of or inability to use the app.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law.

17. Termination

You may stop using AquariumBuddy at any time. We may suspend or limit access to network features if required to protect the app, backend, providers, users, legal compliance, or service reliability, or if you violate these Terms.

Termination does not automatically cancel App Store subscriptions. Manage subscriptions through your Apple Account settings.

18. Changes to These Terms

These Terms may be updated when AquariumBuddy changes, when service providers or legal requirements change, or when purchase, AI, data, or business practices change. The effective date above shows when this version took effect. Continued use of AquariumBuddy after an update means you accept the updated Terms, to the extent permitted by law.
